These Terms of Use govern access to and use of the Nexte platform. They apply to every user from the moment an account is created or any part of the service is used.
Article 1. Purpose and contractual documents
These Terms of Use define the conditions governing access to and use of the Nexte platform. They are complemented by the Terms of Sale, the Legal notice and the Privacy policy. In case of conflict, these Terms of Use prevail unless otherwise expressly stated.
Article 2. Acceptance
Access to and use of the platform imply full and unreserved acceptance of these terms. This acceptance is formalized when the user account is created and constitutes an electronic signature within the meaning of French civil law.
Article 3. Description of the service
Nexte is an all in one SaaS solution for freelancers, sole traders and agencies. It notably includes project management, CRM, billing, professional document generation, internal messaging, client spaces, visual feedback, electronic signature, integrations, time tracking, profitability analysis, satisfaction surveys and integrated support.
Article 4. Access conditions and registration
Access is reserved for adults with full legal capacity, legal entities represented by authorized persons, and emancipated minors recognized as such by a judicial decision. Registration requires accurate and up to date information, including name, valid email address, secure password and any other information requested during sign up.
Article 5. User account and security
Users are solely responsible for the confidentiality and security of their credentials. They undertake not to share credentials, to use a strong and unique password, to activate additional security measures when available, to report suspected unauthorized access immediately and to log out on shared devices.
Article 6. Obligations and prohibited conduct
Users must use the platform in accordance with its intended purpose and all applicable laws. Unlawful or fraudulent use, attacks against security or availability, automated extraction of data, identity theft, unlawful content, harm to Nexte's reputation, circumvention of restrictions and generation of fraudulent documents are prohibited.
Article 7. Intellectual property
All elements making up the Nexte platform remain the exclusive property of the publisher or are used under authorization. Any unauthorized reproduction, publication, distribution or exploitation is prohibited. Content created by users remains their property, but they grant Nexte a limited license to host, store and display it solely to provide the service.
Article 8. Personal data
Nexte processes personal data in accordance with the GDPR and the French Data Protection Act. Full details are set out in the Privacy policy. Users retain rights of access, rectification, erasure, restriction, portability and objection, exercisable at contact@getnexte.com.
Article 9. Responsibilities and limitations
Nexte is bound by an obligation of means, not an obligation of result. The publisher may not be held liable for losses resulting from use of the platform, user generated content, third party integrations, the legal compliance of user generated documents or force majeure. In all cases, liability is capped at the amounts actually received for the subscription during the three months preceding the event giving rise to the damage.
Article 10. Availability
Nexte strives to keep the platform available at all times. Access may nevertheless be suspended because of maintenance, technical upgrades, incidents beyond the publisher's control, emergency security measures or force majeure. No specific service level agreement is guaranteed.
Article 11. Pricing and subscription
Nexte may be offered through free beta access and paid plans. During beta phases, features may be limited, modified or interrupted at any time. Paid plans and their pricing are described in the Terms of Sale and on the platform's pricing page.
Article 12. Termination and account deletion
Users may terminate their account at any time from the settings or by email. Nexte may suspend or delete an account in the event of breach, abusive or unlawful conduct, false information, persistent non payment or behavior harmful to Nexte or other users. Following termination, users generally have 30 days to export their data, subject to legal retention obligations.
Article 13. Amendments
Nexte may amend these Terms of Use at any time. In the event of a substantial change, users will be informed by email and through the platform at least 15 days before the change takes effect. Continued use of the service constitutes acceptance of the updated terms.
Article 14. Information for sole traders
Nexte is particularly intended for freelancers and French micro entrepreneurs. Information relating to social contributions, labor law status and official resources is provided for information purposes only and does not constitute legal or tax advice.
Article 15. Applicable law and jurisdiction
These Terms of Use are governed by French law. In the event of a dispute, the parties will first seek an amicable resolution. Failing that, the competent courts in the jurisdiction of the publisher's registered office in Évry shall have jurisdiction, subject to mandatory consumer protection rules.
