These Terms of Sale govern the contractual relationship between Nexte and any user who accesses the service or subscribes to a paid plan.
Article 1. Service presentation
Nexte is a software as a service platform for freelancers and agencies. It provides project management, client communication, document storage, invoice generation, client space customization, electronic signature, booking links and third party integrations.
Article 2. Access and account creation
Access requires the creation of a user account. Users undertake to provide accurate information, keep credentials confidential and notify Nexte immediately of any unauthorized use of the account.
Article 3. Pricing and payment
- Current prices are published on getnexte.com
- Subscriptions are billed in advance for the selected period
- Payment is due on the subscription or renewal date
- Paid subscriptions are due for the current period and are not refundable unless otherwise required by law
- In case of non payment, access may be suspended after reminder
Article 4. Use of the service
Users must use Nexte lawfully, fairly and in accordance with these terms. Fraudulent use, attacks against the platform, resale to unauthorized third parties, malicious code, scraping and identity theft are prohibited.
Article 5. Ownership of data and content
Users remain the sole owners of their data, documents and content hosted on Nexte. Nexte does not exploit that data for advertising, resale or external commercial purposes.
Article 6. Availability and service levels
Nexte uses reasonable efforts to keep the service available at all times. Temporary interruptions may occur for maintenance, technical incidents or emergency security measures. Nexte's liability remains limited to the amounts actually received for the subscription during the current month.
Article 7. Intellectual property
The Nexte platform, interface, source code, trademarks, logos, visuals and all related elements remain the exclusive property of Rayan Belabed, trading as Mentra. Use of the service grants no ownership right over these elements.
Article 8. Termination
The user may terminate the account at any time through the application or by email. For paid subscriptions, termination takes effect at the end of the current billing period and no pro rata refund is granted. Nexte may also suspend or terminate an account in the event of breach, abusive behavior or persistent non payment.
Article 9. Right of withdrawal
Under Article L221 28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium once performance has begun with the user's express consent and waiver.
Article 10. Changes to the Terms of Sale
Nexte may amend these terms at any time. In the event of a substantial change, users will be notified by email at least 15 days before the change takes effect. Continued use of the service constitutes acceptance of the updated terms.
Article 11. Applicable law and dispute resolution
These Terms of Sale are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the matter shall be brought before the competent courts in the jurisdiction of the publisher's registered office in Évry. Consumer users may also resort to a consumer mediator.
